摘要：隨著社會(huì)經(jīng)濟(jì)的快速發(fā)展，汽車已成為當(dāng)今社會(huì)的主要道路運(yùn)行工具，人們對(duì)汽車的需求增加導(dǎo)致二手汽車交易日趨活躍。而由于我國(guó)汽車市場(chǎng)受舊的政策和管理模式的影響，使汽車交易十分混亂，隨之訴諸法院的案件也不斷增多。如何處理此類案件，在法律界始終眾說(shuō)紛紜。筆者結(jié)合自己承辦的案件，提出了在汽車交易中所存在的六個(gè)方面的法律問(wèn)題，經(jīng)逐一探討后，作出如下觀點(diǎn)：一、汽車買賣辦理過(guò)戶手續(xù)不是買賣合同生效的必備條件，不能因未辦理過(guò)戶手續(xù)就認(rèn)定買賣合同無(wú)效；二、汽車買賣中物的占有與物權(quán)登記相沖突時(shí)，應(yīng)根據(jù)登記所具有的物權(quán)公示效力及公信效力，保護(hù)善意第三人利益；三、汽車買賣未過(guò)戶的產(chǎn)權(quán)歸屬，應(yīng)具體分析物權(quán)變動(dòng)和債權(quán)平等性問(wèn)題，存在于同一標(biāo)的上的物權(quán)效力先于債權(quán)；四、關(guān)于承包經(jīng)營(yíng)中的汽車買賣關(guān)系，從訂立合同的目的、性質(zhì)、內(nèi)容和相關(guān)法律、法規(guī)的規(guī)定等方面分析，此類承包經(jīng)營(yíng)合同依法成立；五、汽車牌照是市場(chǎng)經(jīng)濟(jì)的產(chǎn)物，具有價(jià)值，可以轉(zhuǎn)讓；六、對(duì)于認(rèn)定未過(guò)戶的汽車交通事故賠償責(zé)任主體，不應(yīng)依據(jù)車輛所有權(quán)的歸屬來(lái)確定，應(yīng)確認(rèn)運(yùn)行支配和運(yùn)行利益的歸屬者為賠償責(zé)任的主體。全文共約8000字。

Peoplehavedifferentopinionsofhowtodealwithsuchcases.

AccordingtosomecasesthatIexperienced,therearelegalproblemsthatexistincarsdealing.Afterstudyingthemonebyone,Ipresentthefollowingopinions.

1.Transferringproceduresarenottheessentialconditionsofbecomingeffectiveofcontracts.Neverconsideritineffectivebecauseofnottransferring.

2.Incaseofconflictofwhoownsthingsandwhohastherighttoregisterincarsdealing,weshouldprotectthethirdperson’sinterestoutofgoodwill,accordingtoeffectiveproofs.

3.Abouttheownershipoftheuntransferredcars,weshouldpracticallyanalyzetheproblemsofthechangeofownershipandequalityofcreditors’rights,andtheeffectofownershipshouldbefavoredovercreditors’rightsifonthesameconditions.

1.Aboutcarsdealingrelationshipinmanagingintheformofcontract.Fromtheaspectsofthecontracts’purpose,nature,contentandrelatedlawsandrules,suchkindofcontractscanbeeffectivebylaw.

2.Carlicensesaretheresultofdealingineconomylife,sotheycanbetransferred.

3.Onjudgementaboutwhoshouldbemainlyresponsibleforthecompensatingforthetrafficaccidentofcarsthatarenottransferred,weshouldn’tjudgebytheownershipofcarsbutweshouldjudgebywhocanbenefitfromthemanagementofthecars.
